1. Agreement to These Terms

These Terms of Service ("Terms") form a legally binding agreement between you and BioScribe ("we", "us", or "our").

By accessing or using the BioScribe website, application, or services (the "Service"), you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Description of the Service

BioScribe provides a platform that enables users to create personal life-story content through guided conversations and AI-assisted transcription and writing, with the option to produce printed books through third-party printing providers.

The Service includes:

• A free introductory preview
• Paid access to story creation features
• Optional printing and fulfilment services provided by third parties

BioScribe does not provide professional writing, therapeutic, medical, legal, or financial advice.

3. Eligibility and Account Registration

To use the Service, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the confidentiality of your account credentials
• Notify us promptly of any unauthorised access or use

You are responsible for all activity that occurs under your account.

4. Pricing and Payments

Pricing Structure

At the time of writing, the Service includes:

• A free preview experience
• A one-time payment for full book creation, which includes:
  • Guided conversations
  • AI-assisted transcription and writing
  • Editorial structuring and layout
  • One printed hardcover book up to a specified page limit
• Additional pages, extra copies, and shipping are charged separately at order time

Payment Terms

• Payments are processed securely by Stripe
• BioScribe does not store full payment details
• Prices may change from time to time; changes do not apply retrospectively

Refunds

Except where required by Australian Consumer Law, payments are non-refundable once the paid Service has commenced.

Nothing in these Terms excludes or limits your rights under the Australian Consumer Law, including guarantees that cannot be excluded by law.

5. User Content and Intellectual Property

Ownership

You retain ownership of all content you submit to the Service, including stories, text, images, and other materials ("User Content").

Licence to BioScribe

By using the Service, you grant BioScribe a non-exclusive, royalty-free, worldwide licence to:

• Process, store, reproduce, and modify your User Content
• Use AI services (including third-party providers) to transcribe and generate written content
• Create digital and printed outputs as requested by you

This licence exists solely to provide the Service.

User Responsibility

You represent and warrant that:

• You own or have the right to use all User Content
• Your User Content does not infringe third-party rights or violate any law
• You have consent from any person whose personal information appears in your content

BioScribe is not responsible for verifying the accuracy or legality of User Content.

6. AI-Generated Content and Approval

The Service uses automated systems and artificial intelligence to generate transcripts and written content.

You acknowledge and agree that:

• AI-generated content may contain errors or inaccuracies
• You are responsible for reviewing and approving all content before finalisation or printing
• BioScribe is not responsible for factual inaccuracies that originate from User Content or AI interpretation

Final responsibility for the content rests with you.

7. Printing and Fulfilment

Printed books are produced and shipped by third-party providers selected by the user.

BioScribe:

• Does not manufacture or ship physical books
• Is not responsible for delays, defects, or issues caused by third-party printers or carriers
• Is not liable for shipping costs, customs fees, or delivery failures

Any disputes relating to printing or shipping may need to be resolved with the relevant provider.

8. Prohibited Use

You must not use the Service to:

• Violate any law or regulation
• Infringe intellectual property or privacy rights
• Upload malicious code or interfere with the Service
• Harass, abuse, or harm others
• Impersonate another person
• Scrape, reverse engineer, or exploit the Service
• Use the Service for commercial purposes outside personal biography creation

We may suspend or terminate access for breaches of this section.

9. Service Availability and Changes

We may modify, suspend, or discontinue the Service (or any part of it) at any time.

We do not guarantee:

• Continuous availability
• Error-free operation
• That the Service will meet all expectations

To the extent permitted by law, BioScribe is not liable for interruptions or changes to the Service.

10. Termination

We may suspend or terminate your access if you:

• Breach these Terms
• Use the Service unlawfully
• Pose a risk to the Service or other users

You may stop using the Service at any time.

11. Consumer Law Notice (Important)

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy available under the Australian Consumer Law that cannot be lawfully excluded.

Where a guarantee applies, BioScribe's liability is limited (at our option) to:

• Re-supply of the Service, or
• The cost of having the Service re-supplied

12. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available".

We do not warrant that the Service will be uninterrupted, error-free, or suitable for your specific purpose.

13. Limitation of Liability

To the maximum extent permitted by law:

• BioScribe is not liable for indirect, incidental, consequential, special, or punitive damages
• BioScribe is not liable for loss of data, profits, revenue, goodwill, or opportunity
• BioScribe's total liability is limited to the amount you paid for the Service in the 12 months preceding the claim

14. Indemnity

You agree to indemnify and hold BioScribe harmless from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from:

• Your use of the Service
• Your User Content
• Your breach of these Terms

15. Governing Law and Jurisdiction

These Terms are governed by the laws of Victoria, Australia.

You agree to submit to the exclusive jurisdiction of the courts of Victoria.

16. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised "Last updated" date.

Your continued use of the Service constitutes acceptance of the updated Terms.
